Influencer–Brand Service Agreement
This Agreement is automatically applied when a Brand hires an Influencer through InfluencerPit.
1. Parties
This Agreement is between:
Influencer (“Service Provider”)
Brand (“Client”)
InfluencerPit (“Platform”), acting only as a facilitator
2. Scope of Work
The Influencer agrees to:
Create and provide the content as described in the booking
Deliver work within the agreed timeframe
Follow advertising guidelines and disclosure laws
Maintain originality and not plagiarize content
The Brand agrees to:
Provide clear instructions
Supply necessary materials (if required)
Respond promptly to messages
3. Payment Terms
Payment is processed securely through InfluencerPit
Funds are held in escrow until the project is marked complete
Influencer is paid once the Brand approves the work
Failure to approve or reject within the required timeframe may auto-complete the order
Chargebacks or fraudulent activity may lead to project cancellation.
4. Revisions
Revisions must be:
Within the original scope
Reasonable and professional
Requested before final approval
Excessive revisions or new requirements may require additional payment.
5. Intellectual Property
Unless otherwise stated:
Influencers retain the copyright
Brands receive a non-exclusive commercial license to use the delivered content
If exclusive rights are needed, they must be negotiated separately.
6. Confidentiality
Both parties agree to keep private:
Unreleased content
Business strategies
Pricing details
Personal information
7. Cancellation & Refunds
Cancellations follow the Refund & Cancellation Policy.
InfluencerPit may:
Issue refunds for non-delivery
Penalize influencers who fail to deliver work
Adjust payments based on completion percentage
8. Disputes
If a disagreement arises:
The Brand or Influencer opens a dispute
Both parties provide evidence
InfluencerPit reviews and makes a final decision
InfluencerPit’s decision is binding within the platform.
9. Limitation of Liability
InfluencerPit is not liable for:
Creative disagreements
Business losses
Influencer’s performance
Brand’s misuse of content
10. Governing Law
This Agreement is governed by Canadian law.
